A dozen GOP governors urge Supreme Court to let states regulate abortion

Alabama, Arizona, Arkansas, Florida, Georgia, Idaho, Iowa, Missouri, Montana, Oklahoma, South Carolina, Texas | July 29, 2021

A dozen Republican governors on Thursday urged the Supreme Court to eliminate federal protections for abortion and instead allow states to regulate abortion.

Led by South Carolina Gov. Henry McMaster, the group argued in a legal filing that the court’s landmark 1973 decision in Roe v. Wade, which established the constitutional right to abortion, and subsequent rulings unlawfully encroach on states’ rights.

“The judicial constitutionalization of abortion represents an unwarranted intrusion into the sovereign sphere of the States,” they wrote. “Returning to the States the plenary authority to regulate abortion without federal interference would restore the proper (i.e., constitutional) relationship between the States and the Federal Government.”

The amicus brief endorsed Mississippi’s effort to have Roe v. Wade overruled next term, and was signed by the Republican governors of Alabama, Arizona, Arkansas, Florida, Georgia, Idaho, Iowa, Missouri, Montana, Oklahoma, South Carolina and Texas….(Excerpts from The Hill)

3 GOP Senators Urge Supreme Court to Overturn Roe v. Wade

Missouri, Texas, Utah | July 27, 2021

Three Republican senators have filed an amicus brief urging the Supreme Court to return the power to make legislation concerning abortion to the states by overturning the historic 1973 Roe v. Wade decision and the 1992 Planned Parenthood v. Casey decision, The Epoch Times reported.

Sens. Josh Hawley of Missouri, Mike Lee of Utah, and Ted Cruz of Texas, said in the brief on Monday that Roe v. Wade’s approach “proved controversial, and conceptually flawed, from the outset,” while the Parenthood v. Casey decision’s undue burden standard is ambiguous and has made it difficult for courts to consistently apply it, calling it “too subjective” and is “unworkable and unpredictable.”

Roe v. Wade prohibits states from banning abortions prior to when the fetus is deemed “viable,” with the ruling asserting that a woman has a constitutional right to an abortion in the “pre-viability” period and that state laws dealing with abortion would have to pass the strict scrutiny standard, the highest and most stringent standard of judicial review that courts use to determine the constitutionality of laws….

House lawmakers accused Planned Parenthood of improperly taking millions of dollars

Florida, Missouri | April 21, 2021

Planned Parenthood improperly took tens of millions of dollars’ worth of government loans intended to help businesses during the coronavirus, according to a group of Republicans who want to see the organization investigated.

House lawmakers accused Planned Parenthood of unlawfully using the Small Business Administration’s COVID-response program, the Paycheck Protection Program, to obtain millions of dollars in taxpayer funds. Reps. Blaine Luetkemeyer (R., Mo.) and Byron Donalds (R., Fla.) wrote that the Committee on Small Business is calling for the Department of the Treasury and the Small Business Administration to investigate the organization’s actions.

“We insist that the SBA and the Department of the Treasury investigate 1.) the distribution of these loans in violation of the relevant affiliation rules and 2.) whether Planned Parenthood violated the law,” the lawmakers wrote in a Friday letter….
